How long does a seller signing take?

A typical seller signing runs 20 to 40 minutes — much shorter than a borrower signing because there is no loan package. Seller documents usually total 15 to 40 pages, with 2 to 5 documents requiring notarization.

What ID do I need for a seller signing?

California law requires a current, unexpired government-issued photo ID for each seller on title — driver license, state ID, U.S. passport, or foreign passport. Expired IDs are not accepted. A thumbprint is required in the notary journal because the grant deed affects real property.

Do all sellers need to sign in person?

Yes — every person on title must personally appear before the notary, present valid ID, and sign in our presence. We cannot notarize a signature for someone who is not physically present, even if you have authorization from them.

Can you come to me if I'm out of state but the property is in California?

Generally no — a California notary can only notarize within California. If you are out of state, you'll need a notary in your state to notarize the grant deed and seller package using California-acceptable language. Your escrow officer can send instructions; many states accept California-style acknowledgments. We can refer you to a remote-online-notary option if your title company allows it.

What is FIRPTA and do I need to sign it?

FIRPTA (Foreign Investment in Real Property Tax Act) requires sellers to certify whether they are U.S. citizens or resident aliens. If you are a U.S. citizen or resident, you sign an Affidavit of Non-Foreign Status — escrow then does NOT withhold the 15% federal tax. If you are a foreign seller, withholding applies. Talk to your escrow officer or CPA before signing.

Can you sign at the property, my new home, or somewhere else?

Yes — your current home, the property being sold, your new home, your office, the escrow office, or anywhere private and well-lit with a flat surface. We come to you anywhere in our service area at the time you choose.

What if the seller has passed away and this is an estate sale?

The signer must be the personal representative, executor, trustee, or successor trustee with authority to sign. Bring the Letters Testamentary, Letters of Administration, Affidavit of Successor Trustee, or Certification of Trust your escrow officer requested. We notarize the signer's capacity exactly as it appears on the document.
