What we notarize

What's typically in a HELOC package.

HELOC packages run 40 to 90 pages, with 4 to 8 documents requiring notarization. We walk through every page, flag what needs your signature, and stamp the documents that need a notary acknowledgment.

  • Deed of Trust The lien securing the HELOC against your property — must be notarized and recorded.
  • HELOC Agreement Defines the credit limit, draw period, repayment period, and rate index. Signed.
  • Notice of Right to Cancel Required for primary-residence HELOCs — starts the 3-day rescission clock.
  • Truth in Lending Disclosure HELOC-specific TILA disclosure with variable-rate examples. Signed.
  • Signature/Name Affidavit Confirms variations of your legal name. Notarized.
  • Subordination Agreement If a first mortgage is being subordinated to the new HELOC (rare). Notarized.
  • Errors & Omissions Agreement Authorizes lender to fix clerical errors after closing. Signed.
  • Interspousal / Quitclaim Deed If the spouse is on title but not on the HELOC. Notarized.

Your exact package depends on the bank or credit union, draw amount, and California-specific addenda. We adapt to whatever your loan officer sends.

HELOC types

Which HELOC are you signing?

The signing process is similar across HELOC types, but package size, required addenda, and rescission rules can differ slightly by lender. Here is what to know for each.

Big-bank HELOC (Wells Fargo, Chase, BofA)

Large-lender HELOC packages tend to be standardized and well-structured — but longer, with extra disclosures and arbitration agreements.

  • Typical package size: 70–90 pages
  • Signing time: 35–45 minutes
  • 3-day right of rescission applies (primary residence)
  • Often includes arbitration agreement and privacy notice

Credit union HELOC

Credit-union HELOCs are usually shorter packages with fewer disclosures — common with Logix, SchoolsFirst, Patelco, and other California credit unions.

  • Typical package size: 40–70 pages
  • Signing time: 25–35 minutes
  • 3-day right of rescission applies (primary residence)
  • Membership agreement may be included

Second-position HELOC

A HELOC behind an existing first mortgage. Your first loan stays in place; the HELOC records as a second lien against the property.

  • Typical package size: 60–90 pages
  • Signing time: 30–45 minutes
  • 3-day right of rescission applies (primary residence)
  • First-mortgage payoff statement NOT included (first loan stays)

HELOC FAQ

Common questions about HELOC signings.

How long does a HELOC signing take?

A HELOC signing typically runs 25 to 45 minutes — shorter than a refinance or purchase. HELOC packages are usually 40 to 90 pages, with 4 to 8 documents requiring notarization.

What ID do I need for a HELOC signing?

California law requires a current, unexpired government-issued photo ID for each borrower — driver license, state ID, U.S. passport, or foreign passport. Expired IDs are not accepted. A thumbprint is required in the notary journal because the HELOC affects real property.

Does the 3-day right of rescission apply to a HELOC?

Yes — for a HELOC on a primary residence, federal law gives you 3 business days after signing to cancel. The line of credit does not become active and funds cannot be drawn until that window closes. We make sure your Notice of Right to Cancel is signed and dated correctly so the rescission period starts on time.

Do both spouses need to sign a HELOC?

In California (a community property state), the non-borrowing spouse usually still has to sign certain documents — often a Quitclaim, Interspousal Transfer, or Spousal Acknowledgment. Your lender will tell us in advance who needs to sign which pages.

What's the difference between a HELOC and a home equity loan?

A HELOC is a revolving line of credit you can draw against (like a credit card) with a variable rate, while a home equity loan is a lump-sum second mortgage with a fixed rate and fixed payment. Both are notarized similarly — the document packages differ but the signing process is the same.

Can you sign at my home, office, or somewhere else?

Yes — your home, your office, a branch lobby, or anywhere private and well-lit with a flat surface and good light. We come to you anywhere in our service area at the time you choose.

Can you explain my HELOC terms, rate, or draw schedule?

No — we are notaries and signing agents, not loan officers or attorneys. We can show you where to sign, initial, and date, but any question about rate, draw period, repayment period, or terms goes to your bank or credit union loan officer.
