Yes. A quitclaim deed must be notarized before the county recorder will accept it for recording. Each grantor must sign in front of a notary.

What is an inter-spousal transfer deed?

An inter-spousal transfer deed is a type of grant or quitclaim deed used between spouses to transfer property without triggering property tax reassessment. It is common when refinancing, separating, or removing a non-borrowing spouse from title.

Do I need a quitclaim deed for a divorce property settlement?

If one spouse is awarded the property in a divorce, a quitclaim deed from the transferring spouse to the receiving spouse is typically prepared by the divorce attorney and must be notarized and recorded to update the public record.

Does a quitclaim deed eliminate my mortgage liability?

No. Recording a quitclaim deed only changes who holds title — it does not remove your name from the loan. Lenders do not release you from the note because a deed was recorded. Consult your lender or attorney about refinancing or assumption.

What county fees apply to a quitclaim deed?

First page recording fee + additional pages + SB2 ($75) + Real Estate Fraud Notification Fee ($7, Gov. Code 27297.6) + AB 1466 ($2). A 2-page quitclaim deed comes to $102 in LA County fees. If the quitclaim is not subject to documentary transfer tax, the recorder may also add the $10 District Attorney fraud fee (Gov. Code 27388), bringing it to $112.
